The services (“Services”) are provided by “menuworld.in” (“Menuworld”), having its registered office at, 102 / 329-A, St. Anne’s Apartments, Off Pali Mala Road, Bandra, Mumbai-400 050. The “www.menuworld.in”, website is a service for ready print media solutions. The Site and Services are the wholly-owned, copyrighted property of Menuworld, and are subject to Indian copyright protection laws.
1. Requirement to Be in Good Standing
Usage rights (“Rights”) are granted to Account Holders who have an active (not cancelled) account with a valid username and password at “www.menuworld.in”. Menuworld may revoke privileges to anyone it believes is abusing the site, as well as seek legal remedies necessary to protect its copyrights and intellectual property.
2. Services
Access to the Site is free. After browsing, users who wish to avail the Services provided by ‘menuworld.in’ must sign up and fill in the registration form in the manner prescribed. Along with the form and choice of preferred Deliverables (“Deliverables”) an initial registration fee (“Payment A”) is to be made to Menuworld, in a form and manner as specified by Menuworld, from time to time. They must also upload and e-mail to Menuworld, their menu content, their restaurant / company logo, besides all other contact information required to appear in the final menu which they desire to print. On completion of the abovementioned process and on successful payment of the registration fee (Payment A), users thereby become Account Holders (“Account Holders”).
Deliverables include:
• On receipt of Payment A, the Account Holder will be sent via e-mail, the soft copy design sample that was selected when browsing, along with their restaurant logo (to be place in the pre-marked area shown on the selected design).
• The Account Holder must email his approval to Menuworld along with the full advance payment (“Payment B”) as specified to the Account Holder, based on quantities required.
• The development of the artwork for the menu shall include the final selected design, the logo / branding requirement, the proofread menu content and all other materials to be uploaded/e-mailed as specified hereinabove, for inclusion in the artwork for the final menu design.
• The artwork of the menu is then emailed for final approval to the Account Holder.
• After lamination / binding, the required quantity of printed menus, are couriered to the address specified in the Registration Form.
3. Fees
Account Holders after making Payment A and on finalization of menu choice must make Payment B before delivery of final printed matter.
This Payment B is to be made to “Menuworld”, in the form and manner specified by “Menuworld”, from time to time.
Payment A is mentioned on user sign up and is a one-time non-refundable fee.
The Payment B is subject to those rates provided for in the Menuworld Rate Card and made available at “www.menuworld.in”.
Menuworld reserves the right to make amendments to this Payment B as per the subject matter choice and requirements of the Account holder.
Menuworld reserves the right to make amendments and revisions to the fees in its sole discretion fromtime to time.
4. Refunds
We guarantee that you will be happy with your “Menuworld” product. If something however, is not as per what was promised to you, kindly call us and we will make it right. We offer a 100% satisfaction guarantee on our printed products. In the event of damage to / loss of Deliverables due to bad handling, misplacement, improper packaging so as to cause actual loss, the Deliverables shall be reprinted and delivered within a time period mutually agreed upon.
In the event of an Account Holder having made Payment A but wishing to discontinue the service (before final approval), no refund shall be made towards the same.
In the event of Payment B being made, with “Menuworld” unable to deliver due to circumstances mentioned herein above, only Payment B shall be refunded in full.
In no event will an Account Holder be eligible to a refund of Payment B where “Menuworld” is capable of delivery within the stipulated time.
5. Content Submissions from Account Holders
By submitting content, including menu content, names, prices, logos (collectively termed as “Your Content”), in the ordinary course of using the Services, you hereby grant and, where applicable, warrant that the owner of such content or intellectual property has expressly granted, “Menuworld” and its affiliates a non-exclusive, royalty-free, perpetual, irrevocable, license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display “Your Content” in any manner.
6. Rights and Access Privileges Do Not Transfer
“Menuworld” Account Holders are not allowed to transfer, share, trade or sell their usage Rights.
7. Limitation of Warranty and Liability
We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them. In no event will “Menuworld”, its officers, directors, affiliates, or employees be liable for any indirect, special, incidental, economic, or consequential damages arising out of the use or inability to use the site or services.
8. About These Terms
“Menuworld” may modify these terms or any additional terms that apply to Services, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We shall post notice of modifications to these terms on this page. We shall post notice of modified additional terms in the applicable Services. If you do not agree to the modified terms for Services, you should discontinue use.
